Terms of Service
These terms are the agreement between you and Ad in Space. By creating an account or using the app or website you agree to them. If you use Ad in Space for a business, you agree on behalf of that business.
What Ad in Space is
Ad in Space is a marketplace, in an app and on our website, for physical advertising space. Businesses list spaces on their premises where an ad can go, such as a window, a wall, a counter or a screen. Other businesses book those spaces for their ads.
Any account can do both. In these terms, a "space owner" is a business listing a space, and an "advertiser" is a business booking one.
We run the app and website and take payment. Unless the advertiser supplies their own ad, we arrange the production of the ad and its delivery to the space owner as a parcel. We are not the space owner or the advertiser, and we do not own the spaces.
Your account
- You must be 18 or over and able to agree to these terms for your business.
- You sign in with your mobile number. Do not share your sign-in codes. You are responsible for all activity on your account.
- Give your real first and last name. We use it only to contact you; other users never see it.
- Give true business details and keep them up to date. One login can run several businesses. Each has its own listings, bookings, payouts, strikes and ratings. Saved cards are shared across your businesses.
- You can delete your account at any time in Account. Payment records for bookings stay on file as the law requires.
Listing a space
Before you approve your first booking, you must complete verification: a video of your space of up to 30 seconds, recorded in the app with the phone's location, and a card saved with Stripe. Our staff review the video. The card is charged only in the cases described under "When a space owner cancels".
- Only list spaces you have the right to use for ads, and describe them truthfully, including size, position and photos.
- A listing photo must show the space itself, photographed in person. We check listing photos automatically and refuse those that do not show a space for an ad.
- Listing is free. Space owners pay us no fees.
- You can list in the app or on our website. A listing is shown to advertisers as soon as it is saved, marked "Business unverified" until you have verified. Until then you may have up to 3 listings.
- Stickers and signs: we may give you a sticker with a QR code, and you can print an "Advertise here" sign from the app. Use them only on space you have the right to let, and only for the listing they are linked to. We may unlink a sticker that is misused.
- Every 180 days we ask you to confirm a listing is still available. If you do not respond within 14 days, it is hidden until you confirm it.
Booking and paying
An advertiser sends a booking request for set dates, in the app or on our website. The space owner approves or declines it. The advertiser's card is charged when the space owner approves. Payments are handled by Stripe; we never see or store full card numbers.
A listing marked "Instant book" is approved and charged as soon as the request is sent. The space owner may decline it within 24 hours; the advertiser then receives a full refund, and the owner receives no strike.
Listings of space owners who have not yet verified are shown with a "Business unverified" label. No advertiser is charged for a space until its owner has verified.
The advertiser pays the following, all shown at checkout before the request is sent. Together they make up the booking total.
- The space owner's price for the dates.
- Our booking fee: 12% of the space price. It is only refunded with cancellation cover, or when the space owner or we cannot go ahead.
- Card processing: 3% of the booking total before tax, which covers the cost of taking the payment. It is refunded only when the space owner or we cannot go ahead.
- Production, if we make the ad: the cost of producing and delivering it, including tax, plus our 20% margin. Advertisers may supply their own ad instead.
- Optional cancellation cover: 6% of the booking total. See "When an advertiser cancels".
- Optional watermark removal: 2% of the booking total for printed ads, or 1% for screens. Without it, ads we make or show on screens carry a small Ad in Space mark.
Tax is added where it applies and is shown at checkout.
These rates can change. A booking keeps the rates it was requested under.
Booking dates are fixed once requested. The app offers only start dates that leave enough time to produce, deliver and install the ad.
Getting paid as a space owner
We pay the space owner's full price by bank transfer, through Wise, 3 days after the booking ends. This period allows the advertiser to report a problem. To receive payouts, add a bank account in Payout details.
We may hold a payout while we investigate a problem with the booking, or deduct from it any amount you owe us (see "When a space owner cancels").
Making, delivering and putting up the ad
- If we make the ad, we produce it and ship it to the space owner's address.
- If the artwork has fewer pixels than the space needs, we may enlarge it with an image enlarging service once the booking is paid, at no extra charge. This sharpens the image and does not change its content. Advertisers can turn this off for artwork they upload.
- The space owner confirms the parcel has arrived, installs the ad in the listed space for the booked dates, takes the photos the app requests, and removes the ad when the booking ends.
- During a booking, the advertiser may request a new photo of their ad once every 7 days.
- Space owners must keep the space safe and as described, and tell us promptly of any change.
After the booking
When requesting a booking, the advertiser chooses what happens to a printed ad after the booking ends:
- Recycle (the default): the space owner recycles or disposes of it.
- Keep: the space owner stores it for reuse in a later booking with them, and notifies the advertiser if it is disposed of.
- Return: the advertiser arranges and pays for a courier to collect it 1 to 7 days after the booking ends. The space owner packs it in its original packaging. If it is not collected within 14 days of the end date, the space owner may recycle it.
When an advertiser cancels
- Before the space owner approves the request: no charge.
- After approval and before production starts: a refund of the booking total, less the booking fee and card processing.
- After production starts: a refund of the booking total, less the booking fee, card processing and the production cost.
- If the advertiser supplies their own ad: a refund of the booking total, less the booking fee and card processing, if they cancel at least 14 days before the start date. No refund after that.
- With cancellation cover: if they cancel before the start date, a refund of the booking total, less the cover, card processing and any production already completed.
- After the ad is installed: no refund.
When a space owner cancels
If a space owner cancels a paid booking, does not confirm their space is ready in time, or does not install the ad within 3 days of the start date, the advertiser receives a full refund of the booking total. We may also offer the advertiser a similar space nearby that can use the same ad.
The space owner receives a strike. At 3 strikes, their listings are hidden until we review them.
We charge the space owner's saved card for costs already incurred on the booking: the card processing fee on the refund and any production completed. The amount is shown before they cancel. If the charge fails, the amount is deducted from their future payouts and their listings are hidden until it is paid.
New space owners must confirm their space is ready before production starts, by the deadline shown in the app.
When we cannot deliver
If we cannot produce the ad in time, or the ad is not delivered or installed for reasons outside the space owner's control, the advertiser receives a full refund of the booking total and the space owner is not charged.
Dealing with each other
- Bookings, messages and payments must stay on Ad in Space. Do not arrange bookings outside Ad in Space to avoid fees.
- We never share phone numbers or email addresses between users. Other users see your business name, address, opening hours and ratings.
- After a finished booking, each side can rate the other from 1 to 5 stars. Ratings are shown with your business in the app. Both ratings are revealed together, or after 14 days. Ratings must be honest; we may remove ratings that are abusive or false.
What ads may show
- Ads must be legal where they are shown, truthful, and yours to use (you own the artwork or have permission).
- No hate, harassment, adult content, violence, illegal products or services, misleading claims, or other people's private information. Political ads must follow local rules.
- We do not accept businesses, listings or ads for alcohol, tobacco or vaping, drugs, gambling or weapons, or content that shows or promotes gangs, extremist groups or crime.
- We check photos and wording automatically when they are uploaded or saved. Content that breaks these rules is refused. Content that may break them is reviewed by our staff.
- Space owners may decline any request. Anyone can report a listing in the app. We may remove any ad or listing that breaks these rules.
AI images
- The app can make ad designs with AI. AI images are bought in packs through the Apple App Store or Google Play (for example, 10 images). The store takes the payment and handles refunds under its own rules. Packs are one-off purchases, not subscriptions.
- Previews carry a watermark until the ad is booked. The limit is 30 images a day.
- AI images can contain errors. You must check all text, logos and details before booking. You are responsible for the ad as if you had created it yourself.
- We may suspend AI images at any time, for example during a service outage.
Messages from us
We send messages about your bookings, listings and account by push notification, email or text message. We may also send offers and news; you can turn these off at any time in Account → Notifications.
Our liability
We provide the app and marketplace "as is". We take reasonable care to keep them available, but do not guarantee they will be uninterrupted or free of errors.
We are not responsible for what space owners, advertisers or the services we use do, for the content of ads, or for lost profits or indirect losses. As far as the law allows, our total liability to you is limited to the fees you paid us in the 12 months before the claim.
Nothing in these terms takes away rights you have under consumer law that cannot be excluded, in New Zealand or in your own country.
Suspension
We may suspend or close an account that breaks these terms, puts others at risk or is used for fraud. Where we can, we will tell you why and give you a chance to fix it.
Changes to these terms
We may update these terms. If we make a material change, we will notify you in the app or by email before it takes effect. Continuing to use Ad in Space after that means you accept the updated terms.
Governing law
These terms are governed by the laws of New Zealand. Disputes go to the courts of New Zealand.
Data about areas
Figures about a listing's area are estimates from: Stats NZ (2023 Census, licensed under CC BY 4.0); the Ministry of Business, Innovation and Employment's Accommodation Data Programme; official statistics agencies of other countries; and places data © OpenStreetMap contributors (ODbL), Powered by Geoapify. They describe the area, not the listing, and are not a promise of results.
